In February 2021, I called MicroStrategy (Nasdaq: MSTR) the biggest short in the market. That day, the stock closed at $876. As I write, it sits at $206 – a decline of more than 75%. And at its low of this year, in May, it had fallen to $134. That’s a stunning drop of 85%.

I was bearish because of MicroStrategy’s leadership – namely, its CEO. Now it turns out he’s being charged with tax fraud in Washington, D.C.

I believe Tesla (Nasdaq: TSLA) is another great short for some similar, as well as different, reasons.

Tesla makes great cars. I drive a Model 3. I’ve never been a car guy, but I LOVE my car. It looks great and runs great, and the only reason I know what gas costs is because it’s my job to keep track of those things.

However, I can’t say I’m as thrilled with Tesla’s business as I am with its shiny cars.

After years of losses, the company finally turned profitable in 2020. But here’s something you won’t hear the Tesla bulls discussing…

Tesla’s cash cow isn’t its cars. It’s carbon credits.

Companies are granted carbon credits for reducing their carbon output. Electric vehicle (EV) makers like Tesla earn lots of carbon credits because EVs don’t pollute like gas-powered cars do. These credits can be traded and sold to other companies that are up against their carbon output limits, allowing said companies to pump out more carbon.

So Tesla sells carbon credits to companies like General Motors (NYSE: GM) that are putting out more carbon into the environment. And it makes a profit doing so.

Last year, Tesla made $1.5 billion selling carbon credits, something the company disclosed only when forced to by the Securities and Exchange Commission (SEC).

That number is declining. In the second quarter of 2022, revenue from carbon offsets was cut in half.

Tesla’s $68 million profit from selling some of its Bitcoin holdings also added to the second quarter’s bottom-line numbers.

So a meaningful amount of Tesla’s revenue comes from non-car-related activities, the largest of which being carbon offsets, which are declining.

But the most significant aspect of my bearish thesis on Tesla is the company’s founder and CEO, Elon Musk.

The man is brilliant and created a fantastic product. He changed the game. But he’s become distracted, and, frankly, he doesn’t run a good business.

And running a successful international business is hard. It’s even tougher when you’re spending time blasting off into space, making bids for unrelated businesses (Twitter) and getting embroiled in lawsuits with them. One might say you’re not focused on your car company.

Musk’s outspoken, abrasive and impulsive personality has gotten him in trouble with the SEC before, like when he tweeted that he was considering taking Tesla private at $420 and that funding was secured. He was joking. Somehow, the usually jovial folks at the SEC didn’t see the humor.

And Musk’s behavior, such as lashing out at the Federal Aviation Administration for delaying the launch of one of his rocket ships due to safety issues, has turned him into a James Bond villain to some people. And some of those people are his customers, who may stop supporting him.

For years, Tesla was really the only game in town when it came to EVs. Today, buyers have more choices, and some of the new EVs, like those made by Lucid, are gorgeous, fast and fun to drive. Tesla has more competition than it did in the past, and it has a CEO who may be alienating a portion of its customers and whose eye may not be on the ball.

Tesla has also made headlines for mistreating employees. Charges of harassment, discrimination and forcing people to work without being paid for overtime have caught the attention of not only the media but also institutional investors.

That brings me to the last point in my bearish thesis on Tesla: The stock is priced for perfection.

Tesla trades at 66 times earnings, with around 85% earnings growth expected in 2022 and 36% forecast in 2023. Those are high bars to clear. Any shortfall could send the stock plummeting.

Tesla’s cars are fantastic. The CEO is brilliant. But Tesla doesn’t make as much money from its actual products as it would like you to believe. Furthermore, Elon Musk is becoming more and more of a wild card as the weeks go by.

I believe Tesla could fall to $150 in the next 12 to 24 months.

Tesla (NASDAQ:TSLA), meanwhile, fell more than 7% after a mixed third-quarter results, though some on Wall Street touted optimism ahead for the EV maker after management said they are considering initiating a stock buyback.

“We are encouraged that management is considering a $5- $10B buyback and believe it is a constructive use of cash,” Oppenheimer said after lifting its price target on the stock to $436 from $432. “[We] believe depth of demand is outstripping most investor expectations, even when considering a looming recession,” it added.

The broader market was also pressured by a fall in travel stocks as investors weighed up quarterly results from airlines and railroad companies.

Tesla (TSLA) sold a record number of China-made vehicles in November, according to data released by the EV giant Monday. However, multiple reports on Monday said Tesla is also planning to cut its EV production in China, as demand seems to be faltering. Tesla stock tumbled early Monday.

Tesla Q4 delivers 405,278 vehicles, misses expectations by 15,000

Tesla (NASDAQ:TSLA) announced Q4 2022 deliveries of 405,278 vehicles, 40% growth from 2021. That number was short of analyst estimates, which per Bloomberg were 420,760.

Tesla also announced the production of 439,701 vehicles, 47% year over year growth. Model 3s comprised the majority of vehicles produced and delivered, over 95% in both cases.

The press release stated, "We continued to transition towards a more even regional mix of vehicle builds which again led to a further increase in cars in transit at the end of the quarter."

Tesla's continued growth comes after a rough year from the market perspective. Tesla was one of the 10 biggest decliners on the Nasdaq 100 and the S&P 500 last year, and has been under analyst scrutiny over what it and CEO Elon Musk can do to turn around the ship. The last weeks of 2022 saw especially volatile trading.

At the same time, Tesla's stock, which finished the trading year at $123.18/share, is trading nearly 200% above pre-pandemic levels. The deliveries are a key data point for whether Tesla can maintain the necessary growth to support that sort of rise in valuation.

For the year, Tesla produced 1,369,611 cars and delivered 1,313,851 cars. This also represented growth of 47% and 40% respectively, year over year.

Tesla also announced its Q4 earnings release will be on January 25th, and its investor day will be March 1st.

SEOUL (Reuters) - South Korea's antitrust regulator said it would impose a 2.85 billion won ($2.2 million) fine on Tesla (NASDAQ:TSLA) Inc for failing to tell its customers about the shorter driving range of its electric vehicles (EVs) in low temperatures.

The Korea Fair Trade Commission (KFTC) said that Tesla had exaggerated the "driving ranges of its cars on a single charge, their fuel cost-effectiveness compared to gasoline vehicles as well as the performance of its Superchargers" on its official local website since August 2019 until recently.

The driving range of the U.S. EV manufacturer's cars plunge in cold weather by up to 50.5% versus how they are advertised online, the KFTC said in a statement on Tuesday.

Tesla could not be immediately reached for comment.

On its website, Tesla provides winter driving tips, such as pre-conditioning vehicles with external power sources, and using its updated Energy app to monitor energy consumption, but does not mention the loss of driving range in sub-zero temperatures.

In 2021, Citizens United for Consumer Sovereignty, a South Korean consumer group, said the driving range of most EVs drop by up to 40% in cold temperatures when batteries need to be heated, with Tesla suffering the most, citing data from the country's environment ministry.

Last year, the KFTC fined German carmaker Mercedes-Benz and its Korean unit 20.2 billion won for false advertising tied to gas emissions of its diesel passenger vehicles.

The challenge for electric vehicle performance in extreme temperatures is widely known, though EVs are popular in markets like Norway, where four out of five vehicles sold last year were battery-powered, led by Tesla.

A 2020 study of 4,200 connected EVs of all makes by Canada-based telematics provider Geotab found that most models had a similar drop in range in cold weather, primarily because the battery is also used to heat the car for the driver and passengers.

At just above 20 degrees Celsius, the average EV outperformed its stated range, but at minus 15 degrees the average EV had only 54% of its rated range, the study found.

Tesla (NASDAQ:TSLA) stock rose 3.5% after the electric car manufacturer signaled longer waiting times for potential buyers of some versions of the Model Y in China, suggesting increased demand after recently announced price cuts.

Tesla Price Cuts
Tesla cut prices sharply in the U.S., making more of its models eligible for tax credits of up to $7,500. U.S. Model 3 prices have been reduced 6%-14%, depending on the trim. The base Model Range Standard Range RWD was cut $3,000 to $43,990, which means it would be $36,240 after the IRA tax credits. The Performance version was cut $9,000 to $53,990, getting under the $55,000 limit for tax credits. The base Model Y has been slashed $13,000, or nearly 20%, to $52,990. The Performance variant has been cut to $56,990, also down $13,000.

Meanwhile, Tesla cut Model 3 and Y prices in at least Austria, France, Germany, the Netherlands, Norway, Switzerland and the U.K.

The price cuts should significantly boost sales in the U.S. and provide a boost in Europe, where backlogs had been falling significantly. But they also raise concerns about Tesla's prized profit margins.

On Jan. 6, Tesla cut China prices significantly for the second time in less than three months, as inventories swelled despite big year-end incentives and temporary Shanghai plant production halt.

Tesla stock fell 5% in premarket trading. General Motors (GM), Ford (F), Rivian (RIVN) and Lucid (LCID) also declined, as Tesla price cuts may undercut their demand and pricing for EVs and other vehicles.

Tesla Earnings
Tesla earnings slightly topped analyst views, which had come down significantly in the past few weeks. Revenue just missed, according to FactSet, though it beat some other estimates. Tesla recognized $324 million in Full Self-Driving revenue, which drove the EPS beat.

Automotive gross margin fell to 25.9% from 27.9% in Q3 and 30.6% a year earlier. That was below consensus. Gross margins are expected to fall significantly in 2023 following sweeping price cuts worldwide earlier this month.

CEO Elon Musk was bullish on the conference call. He said orders were double production right now following the price cuts. But the question is how strong demand will remain in the coming weeks and months.

Tesla officially expects production of 1.8 million vehicles, but Musk said two million is the internal goal. Tesla produced 1,369,611 vehicles in 2022, delivering 1,313,851. Output topped deliveries by an increasing amount in the past three quarters.

Musk said Cybertruck output will begin by the summer, but "volume production" may not happen until 2024. Tesla will provide further details about an upcoming vehicle at its March 1 investor day. That could be a smaller, cheaper EV. That could open up a big new segment for Tesla, but would face a large number of existing rivals.

Late Tuesday, Tesla said it would invest $3.6 billion at its Nevada gigafactory to mass-produce Semi vehicles and 4680 batteries. But much of the announcement echoed key features of Tesla's unfulfilled plans from 2014.

Tesla (NASDAQ:TSLA) stock rose 2.1% after Bloomberg reported that the electric car manufacturer is set to suspend some production in China until the end of February as it upgrades its facility to make a refreshed version of the Model 3 compact sedan.
