Reuters - Apple Inc (NASDAQ:AAPL) was sued on Monday by French app developers that accused the iPhone maker of violating U.S. antitrust law by overcharging them to use its app store.

The plaintiffs in the proposed class action include Société du Figaro, which develops the Figaro news app; L'Équipe 24/24, which develops the L'Équipe sports news and streaming app, and Le Geste, an association of French content providers.

According to the complaint filed in the federal court in Oakland, California, Apple has abused its monopoly power over app distribution on iOS-based mobile devices by mandating only one app store for those devices.

The plaintiffs said this has enabled the Cupertino, California-based company to charge "supracompetitive" 30% commissions for 14 years, as well as $99 annual fees to app developers, while stifling innovation and consumer choice.

"There is no valid business necessity or pro-competitive justification for Apple's conduct," the complaint said. "Instead, Apple's actions are designed to destroy competition."

Apple did not immediately respond to requests for comment.

Monday's complaint seeks an injunction against further anticompetitive conduct, plus triple damages for violating federal antitrust law and California state laws.

The plaintiffs are represented by the U.S. law firm Hagens Berman Sobol Shapiro, and Paris-based Fayrouze Masmi-Dazi.

Monday's lawsuit resembles an earlier Hagens Berman case against Apple, which resulted last August in a $100 million settlement for smaller iOS developers that called Apple's commissions excessive.

In June, the firm reached a $90 million settlement with Alphabet (NASDAQ:GOOGL) Inc's Google over its app store's treatment of developers.

The case is Société du Figaro et al v Apple Inc, U.S. District Court, Northern District of California, No. 22-04437.

Buy and Hold Apple (AAPL) Stock for the Long Term
by Louis Navellier and the InvestorPlace Research Staff • August 5, 2022
Apple (NASDAQ:AAPL), like other tech stocks, has bounced back in recent weeks. This is largely due to growing speculation that the Federal Reserve will cut interest rates in 2023 in order to minimize the impact of a recession. Lower interest rates are a positive for growth-oriented names like AAPL stock. Lower rates increase the present value of future earnings.

It’s too early to say that rate cuts next year are a done deal. That’s why some commentators are suggesting that selling into strength is the move to make with Apple shares. Further developments could signal the Fed plans to remain hawkish for as long as it takes to fight high inflation. This may result in another tech selloff.

So, is cashing out the best move? Not so fast.

Buy and hold remains the better course of action here.

AAPL Stock: Why You Shouldn’t Cash Out Now

It’s tempting to try to time the market, but it’s easier said than done. In fact, it’s nearly impossible, even for Wall Street pros. Plenty have tried to predict short-term price movements only to find themselves buying high and selling low. In turn, they miss out on the bulk of a stock’s gains.

That’s the key risk you take by selling AAPL stock today while external uncertainties continue. Cashing out today, and waiting things out until there’s another big pullback, may on paper seem like a foolproof strategy. Yet just as it’s far from a lock that relief for growth stocks is just around the corner, it’s also not set in stone that another big selloff looms for tech stocks.

Put simply, if you are bullish on Apple in the long term, don’t cash out in the hopes you can re-enter at a lower price. The opportunity may not arrive. Instead of pulling back, the rally could carry on.

There’s no reason to waste effort and energy trying to trade around this stock. Instead, a set it and forget approach is the more fruitful path to potential profits.

Apple Has Ample Long-Term Runway

What do I mean when I say set it and forget it with AAPL stock? If you already own it, hold onto your position. If you don’t own it yet, lock down a position at current market prices instead of sitting on the sidelines until it falls back to its 52-week low. Splitting hairs over entry price makes little sense.

Why? It’s likely that the bulk of Apple’s gains from here will arrive steadily in the years ahead. Shares stand to move higher when the macroeconomic worries that are holding it back today clear up. From this factor alone, the stock could make its way to prices at or near $200 per share. On a longer timeframe, company-specific catalysts could catapult it to even higher prices.

For instance, a pivot toward making more of the tech giant’s revenue subscription-based will help. Per one sell-side analyst, achieving this could add another $1 trillion to Apple’s already multitrillion-dollar market capitalization.

Its driverless electric car catalyst, another potential needle-mover, is still in motion as well. Don’t forget either that there’s the metaverse, where Apple can level up on its past success.

The Verdict

Currently, AAPL stock earns a B rating in my Portfolio Grader. It’s unclear whether shares will continue to rebound in the near term. Even so, investors holding this stock today, or looking to add it to their portfolios, shouldn’t let near-term volatility get in the way of long-term appreciation.

Gains from here may arrive gradually, but runway is ample. Despite already sporting a valuation in the trillions, it hasn’t hit a growth wall.

Moving toward more of a subscription-based revenue model could produce significant shareholder value. Its move into self-driving electric cars and the metaverse could materially increase the company’s value as well.

There are multiple factors giving it a strong chance of retaking its past high and soaring to even higher prices. Don’t cash out or sit out on AAPL stock today. Holding it as a long-term position is the better move.

Apple Expects to Sustain iPhone Sales in 2022 as Market Slows

(Bloomberg) -- Apple Inc (NASDAQ:AAPL). has asked suppliers to build at least as many of its next-generation iPhones this year as in 2021, counting on an affluent clientele and dwindling competition to weather a global electronics downturn.

The tech giant is telling its assemblers to make 90 million of its newest devices, on par with last year, despite deteriorating projections for the smartphone market, according to people with knowledge of the matter. The Cupertino, California-based company still expects to assemble roughly 220 million iPhones in total for 2022, also about level with last year, according to one of the people.

Apple’s projections, a closely guarded secret, suggest it’s confident about weathering a slump in spending on smartphones and other devices. The global handset market, which slid 9% in the June quarter, is expected to shrink 3.5% in 2022, IDC has forecast.

At a time when Android devices are suffering, the stronger demand for Apple’s new lineup stems from a customer base still willing to spend on premium gadgets, the people said. The virtual demise of Huawei Technologies Co. also has eroded competition in high-end smartphones.

Hon Hai Precision Industry Co., which puts together most of the world’s iPhones, hinted at Apple’s resilience when it said this week that sales of its smart consumer electronics products should be little changed in 2022. A representative for Apple declined to comment.

The world’s most valuable company has promised to be disciplined about spending as economic and geopolitical uncertainty clouds the outlook for 2022 and beyond. Bloomberg reported last month that Apple would slow spending and hiring across some of its teams in 2023.

This week, a cooler-than-anticipated US inflation reading buoyed hopes that interest rate hikes won’t be as aggressive as though. But market observers cautioned the economic outlook remained bleak.

What Bloomberg Intelligence Says

Apple’s near- and mid-term percentage sales growth will likely remain in the mid-single digits, spurred by product-refresh cycles and sales of additional services to its installed base of more than 1.8 billion active devices. Spiking inflation, war in Europe and lingering Covid-19 restrictions in China could elongate the product-refresh cycle, hurting fiscal 2022 sales growth by 2-3% vs. consensus of $394 billion. Apple’s overexposure to China for manufacturing is a major concern, and any disruptions due to either parts shortages or geopolitical issues could seriously hinder its ability to fulfill demand.

—Anurag Rana, analyst

But Apple’s soldiering ahead with plans for its marquee device, which accounts for about half of if its revenue and is the main gateway to profitable services.

Apple is set to launch four new iPhone models that it hopes will break more ground than 2021’s versions, Bloomberg News has reported. The iPhone 14 Pro models are expected to include a much-improved front-facing camera, a new rear-camera system that includes a 48-megapixel sensor, thinner bezels, a faster A16 chip, and a redesigned notch with a pill-shaped cutout for Face ID and a hole punch for the camera.

Before 2021, Apple had maintained a consistent level in recent years of roughly 75 million units for the initial run of a new device through the end of the year. It upgraded its target for 2021 to 90 million, anticipating the first new iPhone since the rollout of Covid vaccines would unlock additional demand. The company, whose iPhone assemblers include Pegatron Corp., posted record sales and profit that fiscal year.

The iPhone should again fuel Apple’s growth this year. Apple’s iPhone and iPad both performed better than feared during the June quarter, though other products -- including Macs and wearables -- fell short of projections. Services, a key growth area for Apple, narrowly missed estimates.

Apple seems to be witnessing “no meaningful impact on its iPhone business in the current macro environment,” Piper Sandler analysts wrote after its results.

Apple Stock Earns a New Street-High Price Target at Wedbush on iPhone 2023 Cycle

A Wedbush analyst raised the price target on Apple (NASDAQ:AAPL) to $220 per share, from the prior $200, which is a new Street-high.

The analyst, also known as a big tech bull, said checks showed demand is “holding up firm” as Apple prepares to launch iPhone 14 in the fall.

“We believe the initial order for 90 million iPhone 14 units out of the gates has stayed firm and will be roughly flat with iPhone 13 despite the macro storm clouds,” the analyst said in a client note.

Wedbush analysts estimate that almost 25% of 1 billion iPhone users globally are yet to upgrade their phones.

“We believe Apple is expecting another heavy iPhone Pro and Pro Max mix shift which is a clear positive for ASPs heading into FY23. While the base iPhone will stay at the same price we believe a $100 price increase on the iPhone 14 Pro/Pro Max is likely in store given component price increases as well as added functionality on this new release,” the analyst added.

The analyst also believes that Apple is witnessing a better situation from a supply perspective. This will help the Cupertino-based titan ramp up iPhone deliveries with the analyst seeing 220 million iPhone units in FY23 as a “low bar” for the company to beat.

“Apple remains our favorite tech name as we reiterate our OUTPERFORM rating,” the analyst concluded.

Earlier today, a Credit Suisse analyst upgraded Apple shares to Outperform from Neutral with a $201 target price.

Ruszają przygotowania do wojny Stany Zjednoczone kontra Apple. Czy firmie się upiecze, jak niegdyś Microsoftowi?
Maciej Gajewski

Niewiele brakowało, by na skutek postępowania firma Billa Gatesa przestała istnieć.

Microsoft kontra Stany Zjednoczone i Europa.

Stany Zjednoczone kontra Apple.

Modele iPhone 14 będą rozczarowująco podobne do poprzedników – wliczając w to ten sam procesor – aby trzymać w ryzach nowe inflacyjne ceny.

Apple prowadzi rozmowy w sprawie produkcji MacBooków i zegarków w Wietnamie
